  • NOTICE TO ALL PERSONS HAVING A BRAND RECORDED IN HEMPHILL COUNTY

    In accordance with Attorney General Opinion #MW289…”article 6899j V.T.C.S., requires that all marks and brands registered prior to August 30, 1981, must be re-registered within six (6) months of that date, and that the re-registration process must be repeated at subsequent ten (10) year intervals for then-current owners.”

    Marks and brands currently on file will expire on August 30, 2021. This office will be accepting renewals of your brand starting on Tuesday, August 31, 2021. You will have through Tuesday, March 1, 2022 to re-register your brand, thus extending the effectiveness for an additional ten (10) years. If you do not re-register your brand, your registration becomes “void” and will be open for registration to any person desiring to record the brand in their name on Wednesday, March 2, 2022.

    It is not required to complete this application in advance; the County Clerk’s office will provide forms in the office at the time of registration. You must sign the  Application before the clerk or have your signature acknowledged by a notary.

    Fees

    The fee to register a brand in Hemphill County is $16.00 per brand, which includes one location. Additional locations for the same brand are $5.00 each.  Example: If you record “C” on the left hip, the fee will be $16.00.  If you place a “C” on the right hip, it will be an additional $5.00 for that location.  These fees are authorized by section 118.0216 of the Local Government.

    Transfer of Brand

    Brands may be transferred. This requires a notarized affidavit signed by the current brand holder that relinquishes title of the brand to the transferee.
